We'd like to ask as many of you as possible to register as members of Malltraeth Ymlaen Cyf and to accept our policy on the Data Protection Act. Completing this form is important because it helps to set the membership of Malltraeth Ymlaen on a properly constituted basis.
The Memorandum of Association sets out the aims of the Company and what activities it can and will undertake. The Memorandum of Association also sets out a method of limiting the liability of members involved in such activities, but key to this is that we should hold a register of members of the Company. Only properly registered members will fall under this legal liability umbrella! Note 1 (below) explains this further.
No money is involved in joining!
However, you'll notice that we're also asking for you to consent to using photographs of yourself! We're not asking for you to submit photographs, but if we take your photograph at one of our events, and it's published, then we have to have your permission to use it.
When you fill in this form:
- Please don't join as Mr and Mrs . . . just one application for for each member please!
- If you haven't got a telephone number, mobile number or an email address just enter 'None' or leave the box blank
- The fields marked with a red star must be completed.
- When you press send, your email is then sent to the Registrar of Malltraeth Ymlaen Cyf for processing. You'll receive an automatic acknowledgement - this will serve as a check that the contact details you entered are correct. If you don't receive this you might have given us the wrong email address.
- You'll have to tick the 'I'm not a robot box' as well. That's there to block junk mail to the website.
Note 1 - Why becoming a member matters.
Article 8 of the Company's Memorandum of Association says
Every member of the Company promises to pay up to £1 towards the costs of dissolution and the liabilities incurred by the Company whilst they were a member, in the event of the same being wound up while they are a member or within one year after they cease to be a member.
If you become a member you don't have to pay £1, only promise to pay it if the Company becomes liable for any damages or losses to a third party. Your £1 promise is the limit of anything you would have to pay in those circumstances.
You would have to read the Articles of Association from Article 14 all the way through to 33, and perhaps more, to understand why membership matters. The most important point is that it is only members who should vote for any matters of business conducted by Malltraeth Ymlaen Cyf since they are covered against legal liability for the Company's actions. That business includes the election of directors. In the past the Company hasn't conducted its business with properly registered members; membership has only been conferred by precedent.

The Data Protection Act of 2018 now controls how Companies can use people's data. Malltraeth Ymlaen Cyf has to comply with this law. We have to do what's set out in the Act. Malltraeth Ymlaen is committed to processing information in accordance with the data protection legislation.
The General Data Protection Regulation (GDPR) is the new data protection regime which seeks to reinforce the protection of personal data as a basic right – your name, address, telephone number and when appropriate - photos. This means individuals can take more control of their personal details and Malltraeth Ymlaen will be held responsible for collecting and storing this information in a safe and secure way.
In practise, this means Malltraeth Ymlaen cannot pass on any of your details to another individual or group without your consent.
It is necessary, therefore, that the Consent Form is completed by you as a member.
The personal information collected on this form will be held securely and will only be used for administrative purposes and for contacting members from time to time.
You have the right to request a copy of the information held about you and at any time to require corrections or deletions of the information held by Malltraeth Ymlaen. You can ask Malltraeth Ymlaen to stop using any of your details at any time, in which case they will not be used in any future publications, but may continue to appear in publications already in circulation.
